1.About Check on Me
Check on Me is a personal wellness and safety monitoring platform that helps users stay connected with people they trust. The Services may include, depending on your settings and subscription:
- Scheduled and manual wellness check-ins
- Voice verification using on-device analysis of voice samples you provide during setup
- Continuous monitoring that periodically verifies voice activity while enabled
- Storage of emergency contacts you designate
- Alerts to your emergency contacts by SMS, voice call, and/or email when configured triggers occur (for example, missed check-ins, failed voice verification, or manual emergency alerts)
- Optional location sharing during check-ins or alerts
- Account management, preferences, verification history, and optional paid subscription features
2.Important Safety Notice — Not Emergency Services
CHECK ON ME IS NOT A REPLACEMENT FOR 911, EMERGENCY MEDICAL SERVICES, LAW ENFORCEMENT, OR OTHER PROFESSIONAL EMERGENCY RESPONSE.
The Services are designed to supplement personal safety planning. We do not guarantee that alerts will be delivered, received, or acted upon in time to prevent harm. Delivery of SMS, voice calls, and email depends on third-party networks, device settings, and other factors outside our control.
If you are in immediate danger, call 911 or your local emergency number.
3.Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use the Services.
If you are under 18, you may use the Services only with involvement and consent of a parent or legal guardian who accepts these Terms on your behalf.
You represent that the information you provide is accurate and that you have authority to add any emergency contact phone numbers and email addresses you submit.
4.Accounts and Security
To use most features, you must register for an account with a valid email address and password (or other sign-in method we support).
You are responsible for:
- Maintaining the confidentiality of your credentials
- All activity under your account
- Keeping your profile, emergency contacts, and notification preferences up to date
Notify us promptly at support@checkonme.app if you believe your account has been compromised.
5.Emergency Contacts and Recipient Consent
When you add an emergency contact, you represent and warrant that:
- You have obtained that person’s express consent to receive safety and emergency alert messages from Check on Me on your behalf;
- The phone number and email address you provide are accurate; and
- You will not add contacts who have opted out or withdrawn consent.
Emergency contacts may receive SMS, voice calls, and/or emails only when triggered by your account activity (for example, a missed check-in, failed verification, or manual alert). Message frequency is variable and depends on your settings and account activity; contacts typically receive very few messages unless a safety or emergency condition occurs.
Emergency contacts may opt out of SMS at any time by replying STOP to any message. Reply HELP for help. Message and data rates may apply.
We may suspend or terminate accounts that add contacts without proper consent or that misuse alert features.
6.Voice Verification and Audio
Voice profiles and verification analysis are performed primarily on your device. We do not intend to upload raw voice recordings to our servers for routine identity verification, though metadata about verification results (such as pass/fail status and scores) may be stored in your account.
You grant us a limited license to process verification logs and related metadata as described in our Privacy Policy. You are responsible for re-recording or updating your voice profile if your voice changes materially.
Voice verification is probabilistic and may produce false positives or false negatives. Do not rely on it as the sole basis for safety decisions.
7.Location Information
If you enable location features, we may collect and store location data associated with check-ins or alerts you trigger, and may include location links in messages to your emergency contacts.
You can control location permissions through your device settings. Disabling location may limit certain features.
8.Communications from Us
8.1 Email
We may send account-related emails (verification, sign-in PINs, security notices, and service announcements). You may opt out of non-essential promotional email where applicable.
8.2 SMS and Voice
If you provide a mobile number or add contacts with mobile numbers, the Services may send automated SMS and place automated voice calls as described in Section 5. Standard message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
8.3 Push Notifications
With your permission, we may send push notifications for check-in reminders, verification results, and safety alerts.
9.Subscriptions and Billing
Certain features may require a paid subscription processed through Stripe (or another payment provider we designate).
- Subscription fees, billing cycles, and included features are displayed in the app at purchase.
- Subscriptions auto-renew unless canceled before the renewal date through your app store account or in-app billing settings, as applicable.
- Except where required by law, fees are non-refundable for partial billing periods.
- We may change pricing with advance notice where required by applicable law or app store policies.
Payment information is processed by our payment provider; we do not store full payment card numbers on our servers.
10.Acceptable Use
You agree not to:
- Use the Services for harassment, stalking, or monitoring someone without their knowledge and consent
- Add emergency contacts without their permission
- Submit false emergency alerts or abuse alert systems
- Reverse engineer, scrape, or interfere with the Services
- Violate applicable law or third-party rights
- Use the Services for commercial purposes without our written consent
We may investigate violations and suspend or terminate accounts at our discretion.
11.Intellectual Property
The Services, including software, design, logos, and documentation, are owned by BVigilante LLC or our licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes in accordance with these Terms.
“Check on Me” and related marks are trademarks of BVigilante LLC. You may not use our marks without permission.
12.Third-Party Services
The Services integrate with third parties such as Twilio (SMS/voice), Stripe (payments), email providers, and mobile app stores. Your use of those services may be subject to their terms. We are not responsible for third-party services.
Links to third-party sites (for example, map URLs in alerts) are provided for convenience; we do not control and are not responsible for third-party content.
13.Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
14.Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, BVIGILANTE LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, error-free, or that alerts will reach recipients. Voice verification, location data, and timing of notifications may be inaccurate or delayed.
NO PROFESSIONAL ADVICE. The Services do not provide medical, legal, or emergency-response advice.
15.Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BVIGILANTE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PERSONAL INJURY ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
Nothing in these Terms limits liability for death or personal injury caused by gross negligence, fraud, or other liability that cannot be excluded by law.
16.Indemnification
You agree to indemnify and hold harmless BVigilante LLC from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your violation of these Terms, your emergency contact practices, or content you submit.
17.Termination
You may stop using the Services and delete your account at any time through in-app settings or by contacting support@checkonme.app.
We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Services. Provisions that by their nature should survive termination will survive (including Sections 5, 14–19).
18.Dispute Resolution; Arbitration
Please read this section carefully. Except where prohibited by law, you and BVigilante LLC agree to resolve disputes through binding individual arbitration rather than in court, and you waive the right to participate in class actions.
Before filing arbitration, the parties will attempt good-faith informal resolution by sending written notice to legal@checkonme.app (from you) or to the email on your account (from us), describing the dispute. If unresolved after 60 days, either party may commence arbitration under the rules of the American Arbitration Association (AAA) in your county of residence or another mutually agreed location.
You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@checkonme.app with your name, account email, and a clear statement that you opt out.
If arbitration is unenforceable for a particular claim, that claim will be brought in state or federal courts located in the State of Delaware, and you consent to personal jurisdiction there, unless applicable law requires otherwise.
19.Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms and revise the “Last updated” date. Material changes may be notified by email or in-app notice. Continued use after changes become effective constitutes acceptance.
20.General
- Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and BVigilante LLC regarding the Services.
- Severability: If any provision is invalid, the remainder remains in effect.
- Assignment: You may not assign these Terms; we may assign them in connection with a merger or sale.
- Governing law: These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules, except where preempted by applicable consumer protection law in your place of residence.
